A 39-year-old Johannesburg man has been sentenced to life imprisonment for repeatedly sodomising a 32-year-old man at a house in Berea, Gauteng.
NPA South Gauteng Spokesperson Magaboke Mohlatlole revealed in a statement that Oscar Dlamini was sentenced to life behind bars by the Joburg Magistrate’s Court after finding him guilty of rape.
In addition to the life sentence, the court ordered that Dlamini’s name be entered into the National Register for Sex Offenders .
The court also declared him unfit to work with children and also ruled that he is unfit to possess a firearm.
According to the National Prosecuting Authority (NPA), the incident took place on November 13, 2024.
Investigations by Detective Sergeant Rangwetse Kenneth Lethole revealed that the complainant had accompanied a work colleague to a residence in Berea, where they joined Dlamini’s uncle and two other men and consumed alcohol.
Later that evening, the complainant’s colleague went to sleep, leaving him with Dlamini and the other men.
Because it was late, raining heavily and he was unfamiliar with the area, the complainant decided to spend the night at the residence.
While asleep, he woke up to find Dlamini touching him and trying to remove his trousers.
When the complainant attempted to leave, Dlamini allegedly pulled him back onto the bed, prevented him from escaping and raped him.
The following morning, Dlamini allegedly undressed and raped the complainant again.
The complainant eventually convinced the accused to let him leave by telling him he had to go to work . He then went to open a case against at the local police station.
Mohlatlole said a medical examination later confirmed injuries consistent with the complainant’s account.
He said the DNA evidence also linked Dlamini to the crime.
During the trial, Dlamini denied having any contact with the complainant and claimed that the DNA evidence had been fabricated.
However, Acting Regional Court Prosecutor Ruth Phakathi successfully presented the state’s case, leading to Dlamini’s conviction and sentence.
The court rejected Dlamini’s version of events, finding it to be false beyond a reasonable doubt.
The NPA also acknowledged the support provided to the complainant by Court Preparation Officers Dineo Theoha and Gaongalelwe Masetlane before, during and after the trial.
Welcoming the sentence, the NPA said it reflected on the seriousness of the offence and reaffirmed the courts’ commitment to protecting victims of sexual violence while ensuring perpetrators are held accountable.
