The Johannesburg Magistrates’ Court is expected to deliver judgment on Monday, 29 June, in the bail application of alleged police informant and North West businessman Oupa Brown Mogotsi, who is facing a string of criminal charges linked to an alleged staged assassination attempt in Vosloorus.
Mogotsi has been charged with unlawful possession of a firearm and ammunition, perjury, and defeating the ends of justice after police alleged that he orchestrated a fake attempt on his life and subsequently misled investigators.
The case has attracted significant public attention because of Mogotsi’s alleged connections to several high-profile political figures and ongoing investigations into corruption and organised crime.
According to court proceedings, the State alleges that Mogotsi falsely reported that he had survived an assassination attempt in Vosloorus, east of Johannesburg. Investigators, however, allegedly uncovered evidence suggesting that the incident was staged and that the accused made false statements to law enforcement authorities regarding the circumstances surrounding the shooting.
The prosecution further contends that Mogotsi was found in unlawful possession of a firearm and ammunition and that his actions amounted to perjury and an attempt to obstruct the course of justice by misleading police investigators.
During his bail application, the State strongly opposed his release, arguing that Mogotsi poses a risk to the administration of justice and could potentially interfere with witnesses or ongoing investigations if granted bail.
Prosecutors also questioned certain aspects of Mogotsi’s personal circumstances presented to the court, including information relating to his residential address and financial means. They argued that he misled the court about his correct physical address.
Mogotsi, through his legal representatives, has denied any wrongdoing and maintains that he should be released on bail pending the finalisation of his case. His defence team argued that he is not a flight risk, has cooperated with authorities and would comply with any conditions imposed by the court.
The court previously heard testimony from investigating officers and considered evidence presented by both the State and the defence before reserving judgment.
The outcome of the bail application is expected to provide an early indication of the strength of the State’s case and whether the court believes there are sufficient grounds to keep the accused behind bars while investigations continue.
Should bail be denied, Mogotsi will remain in custody pending further court appearances and the progression of the criminal case against him. If granted bail, he is likely to be released under strict conditions determined by the court.
