Attorney Charlotte Tibana and her husband, Peter Nonyane, a Tshwane Metro Police Department officer, will bring a bail appeal in the Polokwane High Court on Wednesday after they were denied bail by the lower court.
The couple faces charges relating to the alleged theft and laundering of money from deceased estates.
Nonyane, popularly known as “Gagash”, was arrested in Pretoria on August 14, while Tibana handed herself over to authorities in Polokwane on August 17.
The State alleges that the pair unlawfully transferred money from accounts linked to deceased estates and used some of the funds to purchase luxury vehicles.
They initially faced charges of fraud and money laundering, with earlier court proceedings indicating allegations involving more than R3 million from deceased estates.
The charges were subsequently expanded. By September, the couple was facing 43 charges after the State added six further counts of money laundering. The State alleges that the accused stole money from the estate accounts of five families.
The State alleges that R1.029 million linked to one of the estates was transferred to an account registered in the name of Jabulani Maluleke.
The accused have remained in custody after their bail application was unsuccessful.
They will now approach the Polokwane High Court seeking to overturn the lower court’s decision to deny them bail.
The National Prosecuting Authority’s Limpopo spokesperson, Mashudu Malabi, confirmed that the bail appeal is scheduled for Wednesday.
The matter is set down for 12.30pm for 2pm for a media application at the High Court of South Africa, Limpopo Division, Polokwane.
