All eyes are glued to the Western Cape High Court in Cape Town, which is set to rule on the bitter legal battle over the appointment of an evidence leader for Parliament’s Section 89 Impeachment Committee.
The matter was argued in court today, with the future of the impeachment inquiry hanging in the balance.
The Economic Freedom Fighters (EFF) and the African Legal Professionals Association are challenging the committee’s controversial decision to rescind its initial recommendation of Advocate Thandazani Madonsela as Evidence Leader.
The committee had initially recommended Madonsela to lead evidence in the high-stakes inquiry, before abruptly voting to reverse its own decision and reopen the recruitment process.
The EFF argues that the U-turn – which came after executive objections – raises serious constitutional questions about Parliament’s independence and the separation of powers.
In court papers, the opposition party contends that allowing the executive to influence who leads evidence in an impeachment process undermines the very foundation of parliamentary oversight and sets a dangerous precedent for political interference.
The Impeachment Committee is opposing both applications, insisting it acted within its mandate to ensure a fair, transparent and credible process.
But the case has now thrust the Western Cape High Court into the centre of a national political storm.
The court’s ruling is expected to have far-reaching consequences, potentially derailing or reshaping the procedural timeline and direction of the impeachment inquiry itself.
