NPA declines to prosecute Greg Maloka over sexual harassment case

The National Prosecuting Authority (NPA) has declined to prosecute former Kaya FM station manager Greg Maloka over allegations of sexual harassment and intimidation brought against him by media executive Tsholo Lethoko.

Africa Daily can exclusively reveal that the decision was communicated to Lethoko on Tuesday by Sergeant Mashele, the Norwood Police Station detective tasked with investigating the case, after the complainant repeatedly contacted police seeking an update on the investigation.

“I can confirm that the detective who has been investigating my case contacted me and told me that the prosecutor who was assigned to assess the case declined to prosecute. No further information was given to me,” Lethoko said.

She said she had requested a nolle prosequi certificate and written reasons explaining why the prosecution authority had decided not to proceed with criminal charges.

“It is my constitutional right to be furnished with all the written reasons used to arrive at that conclusion. The investigating officer promised to furnish me with the reasons on Monday,” she said.

Lethoko said she intended to forward the documents to her lawyers before deciding on the next steps.

The decision marks a significant development in a case involving allegations dating back more than a decade, when Lethoko worked for United Stations, the advertising sales company responsible for the Kaya FM account.

According to Lethoko’s allegations, Maloka made unwanted sexual advances towards her in 2011 .
She alleged that he subsequently treated her in an increasingly hostile manner after she rejected his coital advances.

She alleged that the incidents included inappropriate physical contact, unwelcome comments and invitations to meet after working hours.

Lethoko also alleged that she raised concerns with her superiors and eventually sought intervention from senior figures in the media industry. She resigned from United Stations in December 2011, saying the circumstances had taken a toll on her wellbeing.

The allegations resurfaced publicly following Maloka’s return to Kaya 959 in 2026 as an executive commercial partner for the United Stations, years after he resigned as the station’s managing director in December 2020 amid allegations of sexual harassment and financial misconduct.

An independent investigation commissioned by Kaya FM’s board in 2020 examined allegations of misconduct at the station. Maloka resigned while the matter was under scrutiny. The internal investigation and the current criminal case are separate processes.

Police subsequently investigated Lethoko’s complaint, interviewing witnesses and obtaining statements before referring the docket to prosecutors for a decision.

The NPA’s decision means Maloka will not face prosecution in this case at this stage.
Gauteng Police Spokesperson Amanda Sibeko confirmed that Maloka will not be prosecuted. “ The docket was submitted to the senior public prosecutor on 25 August 2026 for a decision. However, the matter was not placed on the court roll,” she said. Sibeko referred Africa Daily to the NPA for more information. NPA South Gauteng Spokesperson Magaboke Mohlatlole had not responded to our written questions at the time of publication .

Kaya FM 959 Acting Managing Executive Dave Tiltmann confirmed police have informed them that Maloka will not prosecuted.
“ We respect the role of the South African Police Service and the National Prosecuting Authority in assessing allegations and deciding whether a matter should proceed to prosecution and accept theirndecision in this regard. Nevertheless, we acknowledge that this matter has been the subject of significant public interest
and concern, particularly given the serious nature of the allegations and the sensitivities surroundingnsexual harassment and workplace safety. The outcome supports the view of the Kaya 959 board in
respect of the veracity of the allegations,” he said.
