Life for rape of daughter

Judge says father turned into molester

The Supreme Court of Appeal recently upheld the life sentence handed down to a 40 year-old man who raped and impregnated his daughter when she was 16.

The man had pleaded guilty to two counts of rape in the Stanger Regional Court in 2004 after he admitted he bought a bottle of wine and took his daughter to the beach in December 2001.

Judge D Dlodlo said: "It would be wrong to lose sight of the fact that the appellant failed to protect the complainant as her father. He turned into a molester himself. The offences he committed totally destroyed the natural father daughter relationship. In fact the family at large must have been engulfed in a shadow of shame.”

Judge Dlodlo said there were no substantial and compelling circumstances that justified a deviation from the prescribed sentence of life and dismissed the appeal.
